for Use of EUSD Facilities

 

ÌNo tobacco or alcoholic beverages are permitted on any EUSD property ever.

ÌAll applicants agree to comply with the EUSD rules, regulations, policies, and posted signs when on District property.  They also agree to enforce complicance within their participants, and understand the District can choose to ban them permanently for failure to comply or for participants’ failure to comply.

ÌThe serving of food or beverages in carpeted areas is emphatically discouraged, is  rarely permitted and must  be approved in advance by our  facilities use reservation staff.  An additional deposit of $350 for cleaning the carpet in event of spills will be required for any group requesting this permission.  Any soiling or damages to floor covering resulting from such service shall be the financial responsibility of the user for cleaning, repair, or replacement, at District’s discretion.

ÌCancellation of a reservation by an applicant (with prior notification of two full working days) shall be accepted and no charges will be assessed.  Cancellation without notification, or failure to appear at reserved time, will result in full charges.

ÌApplication, certification of insurance, and fees must be completed and submitted to the district ten working days prior to the event.  Applicant will not advertise or promote said event until all site and administrative approvals are complete. (Groups who want to advertise their events in advance must submit applications with sufficient time for the approval process  to be completed before advertising begins.)

ÌSpecific activities prohibited include kite flying, jump houses, model rocketry, dunking booths, skateboarding, archery, trampolines, golfing activities, animal activities, model airplanes/helicopters, rollerblading, jump houses, and any other activities deemed inappropriate by the District.

ÌAny group using school facilities shall be liable for any injuries resulting from its negligence during such use.  The group shall bear the cost of insuring against this risk and defending itself against claims arising from this risk.  All groups shall provide to the District a “Certificate of Insurance” naming the District as an additional insured.  The Application for Use of Facilities will not be processed or considered without this certificate.  All required policies shall be issued by companies who hold a current policyholder’s alphabetic and financial size category rating of not less than A-VII according to Best’s Insurance Report and are licensed to do business in California.

ÌAny group, club, or organization that incudes minors shall have appropriate adult supervision.

ÌApproval of use of district facilities or grounds is granted exclusively to the applicant for the purposes stated on the application.  Said approval may not be assigned to any other group, agency, or individual.

ÌSchool property must be protected from any loss, damage, or destruction.  Each user is responsible for the condition in which school property is left.  If school property is lost, damaged, destroyed, or littered, the user will be charged an amount necessary to replace, repair, or clean the property, and further use of facilities may be denied.

ÌWeapons and dangerous instruments are strictly prohibited on school property.

ÌThe applicant will be held responsible for any fees for damages incurred.  The District shall charge the amount necessary to repair the damages, and may deny the group further use of school facilities.

ÌALL groups using athletic fields (other than sports leagues with season reservations) will be required to pay $3.50 per day or any portion of a day per campus to help offset the cost of portable toilets provided.

ÌSports leagues will be charged a fee for each six-month season for portable toilet(s) at the playing fields..  Leagues sharing a field with a second league will share the expenses.  The portable toilet fees must be paid in advance with the application for use for the entire season.  The District will determine the fees based on reservations for the fields.  Leagues making a reservation that becomes sole use of a field will be charged $390 for each six-month season (January-June or July-December).  Leagues sharing a field with a second league will be charged $195 for each six-month season. 

ÌThe applicant agrees to indemnify and hold harmless the Escondido Union School District, its representatives, officers, agents, and employees from any and all  liabilities, claims, obligations, judgments, suits, costs, damages, expenses, attorney fees, incurred or paid, arising out of, or on account of any property damage or destruction, personal injury or death, or any other damages of whatsoever nature or kind, arising from or on account of the undersigned’s usage of school district facilities and grounds to the full extent provided by the law.

ÌCompliance with the State Storm Water Regulations:   Applicant is required to comply with the State Water Resources Control Board (State Water Board), Water Quality Order No. 2003-0005-DWQ National Pollutant Discharge Elimination System (“NPDS”), General Permit No. CAS000004.  Applicant is to fully familiarize itself with the Permit.  Failure to comply with the Permit is a violation of federal and state law.  Applicant hereby agrees to indemnify and hold harmless District, its officials, officers, agents, employees and authorized volunteers from and against any and all Notices of Violation (“NOV”), claims, demands, losses or liabilities of any kind or nature which District, its officials, officers, agents, employees and authorized volunteers may sustain or incur for Applicant’s noncompliance with the Permit, except for liability resulting from the sole established negligence or willful misconduct of the District, its officials, officers, agents, employees, or authorized volunteers. 

ÌBy signature on the reverse side of this Application for Use of Facilities, the applicant hereby certifies on behalf of the organization applying for use that we uphold the state and federal constitutions and do not intend to use school premises to commit unlawful acts.

Ì If an organization is found to be deceptive in its application information or noncompliant with the terms and conditions of use, that organization is subject to being banned permanently from use of any and all facilities belonging to EUSD.
